Pre-Suit Victory for Estate in Difficult New Jersey Pedestrian Death Case
EAST BRUNSWICK, N.J. - JerseyDesk -- Kemeny, Ramp & Renaud, LLC successfully obtained a $250,000 policy limit pre-suit settlement on behalf of the estate of a 62-year-old man tragically killed in a pedestrian accident on Route 1 in North Brunswick, New Jersey. The settlement was secured Seth Weintraub and Alex Kemeny from Kemeny, despite a police accident investigation that found no fault on the part of the driver and that the pedestrian responsible for the accident
The fatal accident occurred around 3:00 AM in the summer of 2023 near Finnegan's Lane. A police investigation that placed full responsibility on the 62-year-old pedestrian after speaking with the driver and concluding that the pedestrian had been crossing outside a designated crosswalk. Additionally, the pedestrian had no dependents, was not employed at the time of his death, and left behind no surviving spouse or children.

Despite significant legal and factual hurdles, such as the pedestrian having no legal dependents and the official police investigation favoring the driver, Seth Weintraub and Alex Kemeny, presented a compelling demand package challenging the police findings and highlighted roadway visibility issues that could have allowed the driver to avoid the collision.
"Seth did a great job gather details from various source to prepare the settlement demand package and convince the insurance why it should pay the driver's full policy limit to settle the case. Achieving such a settlement prior to litigation not only provides a quick and favorable resolution for the victim's family, it avoid the years of delay and significant costs that are frequently involved in wrongful death cases," said managing partner, Alex Kemeny.
